Option™ ELITE Retrievable Inferior Vena Cava Filter
The lawsuit was filed by Jon F., a man from Oklahoma who was injured by the Option™ ELITE Retrievable Inferior Vena Cava (“IVC Filter”) manufactured by Argon Medical Devices Inc. and Rex Medical, L.P.
The IVC Filter was surgically implanted in his body on August 5, 2014 by Dr. Cordell L. Privat at St. John Medical Center in Tulsa, Oklahoma.
The IVC Filter was retrieved on February 19, 2015. During the surgical procedure, it was noted that the filter was tilted. It required multiple attempts to snare the neck of the filter before it could be removed.
According to the lawsuit:
As a direct result, Plaintiff suffered significant injuries, including, but not limited to a tilted and embedded filter by the Option™ ELITE filter, that occurred as a result of the IVC filter’s failure.”
Argon Medical and Rex Medical are accused of failing to warn doctors and patients that the IVC Filter was subject to breakage, collapse, embedding, tilting, causing thrombus (blood clots), and vein damage.
Lawyers blame the failure of the Option IVC Filter on a “design defect causing the filters to be unable to withstand the normal anatomical and physiological loading cycles exerted in vivo.”
The lawsuit was filed on August 1, 2017 in the Philadelphia County Court of Common Pleas — Case ID: 170703516.
There are now approximately 4,500 other IVC filter lawsuits pending against Rex Medical, Argon Medical, Cook Medical, C.R. Bard, B. Braun, and other manufacturers in state and federal court nationwide.
